These Terms of Service (“Terms”) govern your booking of live entertainment through The Danger Agency, a service of Danger One LLC (“the Agency,” “we,” “us,” or “our”), and your use of thedangeragency.com. By requesting or confirming a booking, or by otherwise engaging our services, you (“Client,” “you”) agree to these Terms. Please read them carefully.
The Agency arranges live magic entertainment, including close-up, walk-around, parlour, and stage performances (each a “Show”), performed by independent professional performers on the Agency’s talent roster. The specific date, time, location, duration, performer, and fee for each Show are agreed in advance by text message, email, or written booking confirmation, which together with these Terms describe the engagement.
A deposit is required to reserve your date and secure the booking. The deposit amount is set for each booking and stated in your quote and booking confirmation. It is paid to the Agency, with the remaining balance due on the day of the Show. A date is not held until the deposit is received. Your booking is confirmed when the deposit is received and the Agency sends you a booking confirmation naming your performer and stating the date, time, venue, fee, deposit, and balance for your Show. Please review the details in your confirmation and tell us right away if anything is incorrect. Inquiries submitted through this site are requests for information and are not confirmed bookings.
The deposit is paid to the Agency; payment instructions are provided with your booking. The preferred payment method is Zelle; payment may also be made by Cash App, Venmo, check, or cash, and payments made by credit card are subject to a 3% processing fee. The remaining balance is paid directly to your performer after the performance, in cash or by any payment method your performer accepts, along with any gratuity if you feel so inclined.
Performances are conditioned upon the performer’s ability to fulfill them. In the case of illness, accident, sudden emergency, act of God, or any other legitimate or unavoidable cause, there shall be no claim for damages by either the Agency, the performer, or the Client. If an unforeseeable emergency prevents your assigned performer from performing, the Agency will, subject to your approval, arrange for a comparable performer from its roster to perform the Show in their place. If no replacement is available or you decline the substitution, then at the Client’s election, all deposits paid will be refunded in full or applied as a credit toward a rescheduled Show.
If the Client cancels or postpones a booked Show, the deposit is non-refundable but may be applied as a credit toward a future Show booked through the Agency, provided that the future Show takes place within one (1) year of the date the deposit was received and a suitable performer is available on the requested date. The credit is applied as a fixed dollar amount toward the future Show’s fee; if that fee exceeds the original fee, the Client is responsible for the difference. Any credit not applied to a completed Show within one (1) year of the date the deposit was received is forfeited. The credit is non-transferable and has no cash value.
If the Client cancels within seven (7) days of the Show, the deposit is forfeited: it will not be refunded and may not be applied as a credit toward a future Show. No further balance will be owed.
Every Agency booking is backed by the “Mind Blown or Your Money Back” guarantee. It covers the magic itself — being genuinely amazed and astonished — not personal taste in humor, comedy, style, or presentation. If your performer’s magic doesn’t blow your mind, you must tell them in person before they leave the venue, and your fee will be refunded in full, deposit included; any unpaid balance is waived. Once your performer has left, the guarantee is void. It does not cover matters outside the performer’s control (such as venue problems, weather, or guest interruptions) or situations where the performer is not permitted to perform the full agreed Show.
Your performer performs for the full length of the Show purchased. Because a Show is an audience-participation program, it may occasionally run a few minutes longer than scheduled, but you always receive the full time booked.
The Client is responsible for providing reasonable performance conditions, including adequate space, access to the venue at the agreed time, and, where applicable, power and parking, along with any gate codes or access instructions your performer will need. For events involving children, a responsible adult must be present throughout the Show. The Client is responsible for the conduct of guests and attendees.
With the Client’s permission, your performer or the Agency may record video and photographs during the Show for marketing and social-media purposes, and any such media remains the sole property of its creator. No recording of the Show is made without your permission. Publicity of the Show is the Client’s sole responsibility; in any publicity materials, your performer shall be referred to by the professional name stated in your booking confirmation.
Performers on the Agency’s roster are independent contractors and not employees or agents of the Agency or of the Client. Each performer is responsible for all applicable state and federal taxes on fees received, and retains exclusive control over the means, method, and details of performing the Show. The Agency acts solely as a booking and coordination service.
The remaining balance is due at the Show. If the Client fails to pay any amount when due, interest may be charged on past-due balances at the rate of one and one-half percent (1.5%) per month (eighteen percent (18%) annually). The Client further agrees to pay all reasonable costs of collection, including attorney’s and collection-agency fees.
The Client shall indemnify, defend, and hold harmless the Agency and the performer from and against any and all lawsuits, claims, actions, and liabilities of any nature arising in any manner from, relative to, or in connection with the Show, except to the extent caused by the indemnified party’s own negligence or willful misconduct. THE AGENCY SHALL IN NO EVENT BE LIABLE TO THE CLIENT FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, AND THE AGENCY’S TOTAL LIABILITY ARISING FROM OR RELATING TO A BOOKING SHALL NOT EXCEED THE FEE AGREED FOR THAT BOOKING.
Performers may carry their own liability coverage. If your venue requires a Certificate of Insurance, contact the Agency before your event and we will let you know what is available for your assigned performer.

These Terms are governed by and construed in accordance with the laws of the State of Texas.
